Acceptable Use Policy
This Acceptable Use Policy applies to Customer and every Authorized User accessing or using the PROTRA platform (the "Service"), and is incorporated by reference into PROTRA's B2B SaaS Subscription and Services Agreement and Terms of Service. Capitalized terms not defined here have the meaning given in the Agreement under which the Service is accessed.
1. Purpose
This policy exists to keep the Service reliable and lawful for every contractor company using it, to protect the individuals contacted through the Service's communications features, and to reduce the risk that PROTRA is used as a channel for unlawful telemarketing, harassment, fraud, or abuse.
2. Prohibited Conduct
When using the Service, Customer and its Authorized Users must not:
- Use the Service for any unlawful, fraudulent, deceptive, harassing, threatening, or defamatory purpose.
- Send SMS, MMS, email, or voice communications without the consent or lawful basis required by the Telephone Consumer Protection Act or other applicable law, or continue contacting a recipient after that person has opted out.
- Use the Service for unlawful telemarketing, robocalling, caller-ID spoofing or manipulation, or mass unsolicited messaging.
- Record or transcribe a call without the notice or consent required in the jurisdiction where the call takes place.
- Represent an AI-assisted call or message as coming from a live person where applicable law requires disclosure that the interaction is automated.
- Upload or transmit malicious code, or attempt to disrupt, overload, or degrade the Service or the infrastructure it runs on.
- Probe, scan, or test the vulnerability of the Service, or attempt to bypass tenant isolation, authentication, rate limits, or other security controls.
- Access, or attempt to access, another customer's account, tenant, or data without authorization.
- Reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent a restriction on those activities is prohibited by applicable law.
- Infringe or misappropriate the intellectual property rights of PROTRA or any third party.
- Resell, sublicense, rent, or provide access to the Service to any third party who is not an Authorized User, except under an arrangement PROTRA has expressly authorized in writing.
- Use the Service to store or transmit content that is unlawful, obscene, or that violates the privacy or publicity rights of others.
3. Communications-Specific Obligations
Customer is responsible for classifying its outbound messages correctly (transactional versus marketing), maintaining suppression and opt-out lists, completing any required A2P 10DLC brand and campaign registration before sending SMS at volume, and retaining evidence of consent for communications features it enables. These obligations exist independently of, and in addition to, any technical safeguards the Service provides.
4. Enforcement
PROTRA may investigate suspected violations of this policy and may remove content, suspend the affected functionality, or suspend or terminate access to the Service, in each case as described in the Agreement governing Customer's use of the Service. Where practical, PROTRA will provide notice and an opportunity to cure before taking action, except where immediate action is reasonably necessary to prevent harm to PROTRA, another customer, or a third party.
5. Reporting a Violation
Anyone who believes the Service is being used in violation of this policy may report it to PROTRA using the contact information below.
6. Changes to This Policy
PROTRA may update this policy from time to time consistent with the change process described in the Agreement governing Customer's use of the Service.
